Litigation-Producing Bonanzas

The Wall Street Journal has an editorial today saying it hasn’t taken Congress long to pay back the trial bar with two litigation-producing bonanzas – the Lilly Ledbetter Equal Pay Act and the Paycheck Fairness Act. The paper calls the former:
Pure gold. It would create a new legal business in digging up ancient workplace grievances. This would also be made easier by the bill's new definition of discrimination. Companies could be sued not merely for outright discrimination but for unintentional acts that result in pay disparities … Elections have consequences, and one price of November's vote is going to be a more powerful, and much richer, plaintiffs bar. Whether or not the U.S. economy creates more income in the coming years, Congress is clearly determined to redistribute it.
